By accessing or using the PC Brain website (pcbrain.ai), software, or any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.
These Terms apply to all visitors, users, and customers of PC Brain. Use of the Software is additionally governed by the End User License Agreement (EULA) available at pcbrain.ai/eula.

PC Brain provides a locally-governed autonomous AI operating system for personal computers, distributed via downloadable installer, along with associated licensing, activation, and update services. We do not operate a cloud platform — your data stays on your machine.
Access to PC Brain software requires a valid license key. License keys are issued to individual users and are non-transferable. You are responsible for keeping your license key confidential and for all use under your key.
You are responsible for maintaining the security of your PC Brain account credentials. Notify us immediately at melo@pcbrain.ai if you suspect unauthorized access. PC BRAIN LLC is not liable for losses caused by unauthorized use of your account.
You must be at least 18 years of age to purchase or use PC Brain. By using the Services, you represent that you meet this requirement.

Pricing for PC Brain licenses is displayed at the time of purchase. All prices are in US dollars unless otherwise stated.
You are responsible for any applicable taxes. New Jersey sales tax will be applied to purchases by New Jersey residents where required by law.
Payments are processed by third-party payment processors. PC BRAIN LLC does not store your credit card or banking information.
Our refund policy is available in full at pcbrain.ai/refunds. Summary: we offer a 30-day no-questions-asked refund on all license purchases. Contact melo@pcbrain.ai within 30 days of purchase to request a refund.
All content, software, branding, and materials associated with PC Brain are the intellectual property of PC BRAIN LLC and are protected by applicable patent, trademark, and copyright laws.
“PC Brain” is a pending trademark of PC BRAIN LLC (USPTO Serial No. 99745429). Nothing in these Terms transfers any intellectual property rights to you.
PC Brain integrates with third-party AI providers (OpenAI, Anthropic, Google) and optional services (smart home platforms, GitHub, etc.) using credentials you provide. Your use of those services is governed by their own terms and privacy policies. PC BRAIN LLC is not responsible for third-party services.
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. PC BRAIN LLC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PC BRAIN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold PC BRAIN LLC harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Services.
We may suspend or terminate your access to the Services at any time if you breach these Terms. You may stop using the Services at any time. Sections on intellectual property, disclaimers, and limitations of liability survive termination.
These Terms are governed by the laws of the State of New Jersey. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Morris County, New Jersey. You consent to personal jurisdiction in those courts.
We may update these Terms from time to time. We will notify you of material changes via the Software’s update mechanism or the email associated with your license. Continued use of the Services after changes constitutes acceptance of the revised Terms.
